Legal & Warranty

Terms & Conditions and Limited Warranty

These Terms govern concrete coating, preparation, repair, resurfacing, sealing, and related services performed by Concrete Shield Coatings Inc. Please read them carefully together with your project quote and any written warranty we issue.

Effective Date: January 1, 2026 Governing Law: State of Illinois Questions? (847) 999-6330

These Terms & Conditions and Limited Warranty apply to concrete coating, concrete preparation, repair, resurfacing, sealing, and related services performed by Concrete Shield Coatings Inc., referred to in these Terms as “Concrete Shield,” “Company,” “we,” “us,” or “our.” By approving a quote, accepting an estimate, scheduling work, paying a deposit, making payment, electronically approving a proposal, or allowing work to begin, the customer agrees that the project is governed by the approved quote, these Terms & Conditions, and any written warranty or maintenance instructions provided by Concrete Shield.

These Terms are intended to supplement the project-specific quote or estimate. If there is a conflict between the quote and these Terms, the quote controls as to scope, price, selected system, and project-specific details. These Terms control as to general conditions, payment, exclusions, warranty limitations, and risk allocation unless the quote expressly states otherwise.

1.Scope of Work

Concrete Shield will perform the work substantially in accordance with the approved written quote, estimate, or work order. The quote describes the coating system, general work area, selected finish, and included services. Any work not specifically listed in the quote is excluded unless approved in writing by Concrete Shield.

Installation methods, preparation requirements, cure times, and completion dates may vary based on actual slab condition, temperature, humidity, access, weather, moisture conditions, substrate contamination, and other site conditions discovered before or during installation.

Concrete Shield may use employees, installers, subcontractors, suppliers, or other qualified personnel to complete the work.

2.Quotes, Estimates, and Changes in Site Conditions

Quotes are based on the conditions visible or disclosed at the time of the estimate. Concrete Shield’s estimate does not guarantee that concealed, hidden, or non-visible conditions do not exist.

If concealed or unforeseen conditions are discovered — including but not limited to moisture issues, weak concrete, spalling, excessive cracking, prior coatings, adhesives, sealers, curing compounds, oil contamination, slope issues, leveling problems, structural movement, or other substrate defects — additional work and charges may be required.

Concrete Shield will notify the customer and obtain approval before performing additional chargeable work, except for work reasonably necessary to secure the site, protect materials, or prevent immediate damage. Approvals may be given by written change order, email, text message, electronic approval, or other written communication acceptable to Concrete Shield.

3.Customer Responsibilities

Unless otherwise stated in the quote, the customer is responsible for the following before Concrete Shield arrives:

  • Providing working electrical outlets within 100 feet of the work area.
  • Providing adequate lighting.
  • Providing safe and reasonable access to the work area.
  • Ensuring the work area is clean, dry, and cleared of vehicles, appliances, shelving, tools, equipment, personal property, debris, stored items, and fragile belongings.
  • Removing or protecting sensitive items in adjacent areas.
  • Keeping children, pets, tenants, guests, and other persons away from the work area during preparation, installation, and curing.
  • Ensuring that water intrusion, leaks, irrigation, drainage, sump discharge, and other sources of moisture are addressed before installation.
  • Notifying Concrete Shield of any known moisture problems, prior coatings, sealers, curing compounds, oil spills, chemical spills, structural issues, prior repairs, or other conditions that may affect the project.

Concrete Shield is not responsible for damage to items left in or near the work area unless the damage is caused by Concrete Shield’s gross negligence or willful misconduct. If the work area is not ready, inaccessible, unsafe, wet, blocked, or unsuitable for installation when the crew arrives, additional fees may apply.

4.Access, Clearance, and Site Readiness

The customer must make reasonable efforts to clear the work area before the scheduled arrival time. The work area should be free of vehicles, appliances, shelving, tools, equipment, boxes, personal items, stored materials, debris, and other obstructions unless Concrete Shield has agreed in writing to assist with moving items.

If the work area is not cleared, inaccessible, unsafe, wet, blocked, contaminated, or otherwise not ready for installation when the crew arrives, Concrete Shield may reschedule the project and may charge a reasonable additional fee for extra labor, waiting time, travel, remobilization, or return visits.

If Concrete Shield agrees to assist with moving, clearing, or returning contents, an additional service fee may apply. Concrete Shield may refuse to move items that are heavy, fragile, valuable, hazardous, attached to the structure, improperly packed, or otherwise unsafe to move.

Returning vehicles, appliances, shelving, tools, boxes, stored items, or other contents to the serviced area is the customer’s responsibility unless Concrete Shield separately agrees in writing to provide that service. Concrete Shield will make reasonable efforts to communicate any additional charges before performing added services whenever practical.

5.Surface and Substrate Conditions

The coating system bonds to the existing concrete substrate. The performance and appearance of the coating depend heavily on the condition, strength, porosity, cleanliness, and stability of the concrete.

The coating system is not a structural repair, waterproofing system, vapor barrier, slab-leveling system, foundation repair, or substitute for properly constructed concrete.

Existing or future concrete conditions may affect appearance, adhesion, durability, and warranty coverage. These conditions include but are not limited to:

  • Cracks, control joints, and expansion joints.
  • Spalling, pitting, and dusting concrete.
  • Weak, deteriorated, hollow, or delaminated concrete.
  • Prior coatings, paint, sealers, adhesives, or curing compounds.
  • Oil, silicone, or chemical contamination.
  • Efflorescence, moisture vapor transmission, hydrostatic pressure, and high alkalinity.
  • Slab movement, settling, heaving, or structural shifting.

Concrete Shield may repair or treat cracks, pits, spalls, joints, or surface defects if included in the quote or approved as additional work. However, crack repairs, patching, joint filling, and other substrate repairs may remain visible and may reopen or telegraph through the coating if the concrete moves.

Concrete leveling, structural correction, drainage correction, waterproofing, vapor mitigation, foundation repair, or replacement of defective concrete is the customer’s responsibility unless expressly included in the quote.

6.Moisture, Vapor Transmission, Hydrostatic Pressure, and Efflorescence

Concrete is porous and may transmit moisture vapor, soluble salts, alkalinity, or hydrostatic pressure from beneath or adjacent to the slab. These conditions may cause bubbling, blistering, whitening, efflorescence, peeling, lifting, delamination, discoloration, cloudiness, softening, or other coating failure.

Unless a written moisture test and moisture-mitigation system are specifically included in the quote, Concrete Shield’s inspection is visual only and does not guarantee that moisture conditions are absent or will not develop later.

Moisture vapor transmission, hydrostatic pressure, water intrusion, high alkalinity, soluble salts, efflorescence, drainage problems, leaks, condensation, and related slab or site conditions are not caused by Concrete Shield and are excluded from warranty coverage.

If moisture risk is suspected, Concrete Shield may recommend moisture testing, drainage correction, waterproofing, a moisture-mitigating primer, a vapor-reduction system, or third-party remediation. The customer may accept or decline such recommendations in writing.

Important

No coating system is warranted against moisture-related failure unless Concrete Shield issues a separate written moisture warranty specifically covering that condition.

7.Installation, Cure Times, and Use After Installation

Concrete Shield will use commercially reasonable installation practices based on the selected coating system and site conditions. Cure times and return-to-service times may vary based on product type, temperature, humidity, ventilation, coating thickness, slab condition, and weather.

The customer must follow all post-installation instructions provided by Concrete Shield, including instructions regarding foot traffic, vehicle traffic, moving items back onto the surface, cleaning, and maintenance.

Premature use, dragging items, placing heavy objects too soon, exposure to water before cure, chemical exposure, tire exposure before cure, or failure to follow instructions may damage the coating and may void warranty coverage for the affected area.

8.Aesthetic Considerations

Concrete coating systems are field-applied finishes. They are not factory-manufactured surfaces. The customer understands and accepts that natural and normal variations may occur, including:

  • Random chip or flake distribution.
  • Texture, color, and gloss variation.
  • Roller marks, lap lines, and edge differences.
  • Joint, patch, and crack-repair visibility.
  • Uneven concrete profile.
  • Variations caused by lighting, viewing angle, or slab condition.
  • Differences between samples, photos, displays, and the final installed surface.

Samples, photographs, showroom displays, color charts, website images, and prior projects are for general illustration only and do not guarantee an exact match. Repairs, touch-ups, recoats, or partial replacements may not match the original floor in color, gloss, texture, chip distribution, or appearance.

Cosmetic variations are not considered coating failure and are not covered by warranty unless Concrete Shield determines, in its sole discretion, that the variation resulted from defective application outside normal industry tolerances.

9.Out-Gassing, Bubbles, Pinholes, and Slab Air Release

Concrete may release trapped air or vapor during or after installation. This condition is commonly referred to as out-gassing. Out-gassing may cause bubbles, pinholes, small craters, texture variation, or similar surface imperfections.

Out-gassing is affected by concrete porosity, temperature, sunlight, slab history, moisture, and other conditions outside Concrete Shield’s control. Out-gassing bubbles, pinholes, slab air release, and similar naturally occurring substrate-related conditions are excluded from warranty coverage unless Concrete Shield determines that the issue was caused solely by defective application.

10.Slip Resistance and Safe Use

Coated surfaces are not slip-proof. They may become slippery when wet, oily, dusty, icy, chemically contaminated, or exposed to snow, water, grease, cleaners, debris, or other substances.

Optional slip-resistant additives may be available but do not eliminate slip risk and do not guarantee compliance with any particular slip-resistance standard, building code, safety requirement, or use condition unless expressly stated in writing.

The customer is responsible for routine cleaning, safe use, maintenance, and warning occupants, guests, tenants, employees, customers, invitees, or other persons of surface conditions.

To the fullest extent permitted by law, Concrete Shield is not responsible for slips, trips, falls, or injuries caused by water, snow, ice, oil, chemicals, dust, debris, improper footwear, improper maintenance, misuse, contamination, or customer use of the surface after installation.

11.Dust, Grinding, and Clean-Up

Concrete preparation may involve grinding, sanding, scraping, shot blasting, crack repair, patching, or other preparation methods that can create dust, debris, noise, odor, and vibration. Concrete Shield will use reasonable dust-control and clean-up practices, but residual dust may remain in the work area or adjacent areas.

The customer should cover or remove vehicles, appliances, tools, electronics, stored items, shelving, and sensitive belongings in or near the work area before installation. Unless expressly included in the quote, final detailed cleaning of walls, doors, windows, shelving, stored items, personal property, HVAC filters, adjacent rooms, or unrelated areas is not included.

Concrete Shield will remove ordinary installation debris generated by its work. The customer is responsible for unrelated trash, stored materials, hazardous materials, and personal items.

12.Scheduling, Weather, and Delays

Concrete Shield will make reasonable efforts to meet scheduled installation dates. However, scheduled dates are estimates and are not guaranteed unless expressly stated in writing.

Work may be delayed or rescheduled due to weather, temperature, humidity, slab moisture, site access, customer readiness, unsafe conditions, material availability, equipment issues, labor availability, supplier delays, change orders, unforeseen substrate conditions, or other circumstances outside Concrete Shield’s reasonable control.

Delays do not constitute abandonment, breach, or grounds for price reduction. No compensation, discount, or price adjustment will be provided due to scheduling changes unless required by law or agreed in writing by Concrete Shield.

13.Rescheduling and Cancellations

The customer should provide at least 48 hours’ notice to reschedule installation whenever possible.

If the customer reschedules with less than 48 hours’ notice, or if the crew arrives and the site is not ready, inaccessible, unsafe, blocked, wet, contaminated, or otherwise unsuitable for installation, Concrete Shield may reschedule the project and may charge a reasonable fee for travel, waiting time, remobilization, labor, materials, storage, or other costs incurred.

Except where a statutory cancellation right applies, customer cancellation after scheduling may result in forfeiture of the deposit or payment of Concrete Shield’s actual costs, including administrative time, scheduling losses, special-order materials, supplier restocking charges, mobilization costs, and preparation expenses. Any retained deposit or cancellation charge is intended to reasonably compensate Concrete Shield for costs and losses that may be difficult to calculate and is not intended as a penalty.

Nothing in these Terms limits any cancellation right required by Illinois law, federal law, or other applicable law.

14.Illinois Consumer Rights and Required Notices

For residential home repair or remodeling work, the customer may have rights under Illinois or federal law, including cancellation rights, consumer notices, written-contract requirements, insurance-related rights, senior-citizen cancellation protections, and required disclosures.

Concrete Shield intends these Terms to be read together with any legally required notices, brochures, cancellation forms, written contracts, or disclosures. If any legally required consumer notice, cancellation right, or non-waivable customer right applies, that right controls over any conflicting language in these Terms.

The customer should not treat the absence of a signature line on this website version as a substitute for any legally required written contract, electronic acceptance, consumer notice, or cancellation form.

15.Additional Services and Change Orders

Any work not listed in the approved quote must be approved in writing before it is performed. Additional services may include but are not limited to:

  • Extra crack repair, additional patching, or joint filling.
  • Moisture testing or moisture mitigation.
  • Coating removal, adhesive removal, or oil remediation.
  • Heavy grinding or leveling.
  • Extra mobilization or moving contents.
  • Additional topcoat, color, or system changes.
  • Work outside the original area.

Minimum service charges may apply to on-site additions, return trips, and work added after scheduling. Written approval may include email, text message, electronic approval, or other written communication accepted by Concrete Shield.

16.Payment Terms

Unless otherwise stated in the quote, a 30% deposit is required to schedule installation. Final payment is due within 15 days after substantial completion unless the quote or invoice states a different due date.

“Substantial completion” means the coating system or agreed work has been installed or performed in material accordance with the quote, even if minor punch-list items, touch-ups, warranty review, or non-material corrections remain.

Late balances may accrue finance charges of 1.5% per month, or the maximum amount allowed by law, whichever is less. The customer is responsible for reasonable collection costs, filing fees, returned-payment fees, and attorney’s fees where allowed by contract or law.

Concrete Shield does not waive any mechanic’s lien, collection, or payment rights unless a written lien waiver or release is issued by Concrete Shield. Warranty obligations may be suspended until the account is paid in full.

17.Limited Warranties Generally

Concrete Shield provides only the written warranties stated in these Terms, the approved quote, or a separate written warranty document issued by Concrete Shield.

No salesperson, installer, employee, subcontractor, representative, website statement, advertisement, photograph, sample, text message, or verbal statement may create or modify a warranty unless the change is expressly stated in a written document approved by Concrete Shield. All warranties are subject to the exclusions, limitations, claim procedures, and maintenance requirements stated in these Terms.

18.Eligible Residential Garage Limited Lifetime Warranty

Limited Lifetime Warranty

For eligible interior residential garage floor coating systems installed by Concrete Shield and paid for in full, Concrete Shield provides a Limited Lifetime Warranty to the original purchaser.

For eligible installations, Concrete Shield warrants that the coating system will not peel, lift, or delaminate from the concrete substrate due solely to defective surface preparation or defective application by Concrete Shield under normal residential garage use.

This Limited Lifetime Warranty applies only if the quote, estimate, or written warranty expressly identifies the installation as eligible for the Limited Lifetime Warranty.

“Lifetime” means the period during which the original purchaser owns the property where the eligible coating system was installed. This Limited Lifetime Warranty is non-transferable and applies only to the original purchaser.

19.Installations Not Eligible for the Limited Lifetime Warranty

Unless Concrete Shield expressly states otherwise in writing, the Limited Lifetime Warranty does not apply to:

  • Commercial, industrial, retail, warehouse, or restaurant floors.
  • Basements, laundry rooms, or mechanical rooms.
  • Exterior concrete, patios, pool decks, porches, sidewalks, driveways, or garage aprons.
  • Stairs and vertical surfaces.
  • Previously coated surfaces.
  • Moisture-risk slabs or slabs with known hydrostatic pressure or water intrusion.
  • Special-use surfaces and surfaces exposed to unusual chemicals, heavy equipment, forklifts, steel wheels, welding, manufacturing, commercial traffic, or industrial use.

Such installations may carry a different warranty only if expressly stated in the quote or separate written warranty.

20.Standard Limited Workmanship Warranty Tiers for Non-Lifetime Installations

For installations not eligible for the Limited Lifetime Warranty (Section 19), Concrete Shield offers a written limited workmanship warranty. Unless the quote states a different warranty period or expressly states that no warranty applies, the standard warranty tiers are:

  • Residential basements — 5 years. Five-year limited workmanship warranty against peeling, lifting, or delamination caused solely by defective preparation or defective application by Concrete Shield under normal residential use.
  • Exterior surfaces — 5 years. Outdoor patios, pool decks, porches, driveways, garage aprons, sidewalks, stairs, and other exterior concrete surfaces carry a five-year limited workmanship warranty against peeling, lifting, or delamination from defective preparation or application. UV exposure is excluded unless expressly covered in writing.
  • Commercial floors — 3 years. Commercial, industrial, retail, warehouse, restaurant, parking garage, salon/spa, and similar non-residential installations carry a three-year limited workmanship warranty against peeling, lifting, or delamination from defective preparation or application under normal commercial use.
  • Other installations — 1 year minimum. Mechanical rooms, laundry rooms, vertical surfaces, previously coated surfaces, special-use surfaces, and any installation not specifically covered above carry a one-year limited workmanship warranty unless the quote states a different period.

Each of these warranties covers peeling, lifting, or delamination caused solely by defective preparation or defective application by Concrete Shield under normal use of the coated area. They do not cover substrate failure, moisture-related failure, cosmetic variation, staining, cracking, damage, abuse, exterior weather damage, improper maintenance, or any excluded condition listed in these Terms.

The applicable warranty tier and period for each project will be identified in writing on the quote, estimate, or written warranty document issued by Concrete Shield.

21.Warranty Labor and Materials

For covered warranty claims reported within one year after substantial completion, Concrete Shield will provide reasonable labor and materials necessary to repair the affected area, subject to all exclusions and limitations. This applies to the Limited Lifetime Warranty and to each of the standard workmanship warranty tiers in Section 20.

After the first year and through the remainder of the applicable warranty period — including the Limited Lifetime Warranty and the multi-year tiers in Section 20 — coverage is limited to replacement coating materials required to repair the affected area. After the first year, the customer is responsible for labor, travel, freight, delivery, preparation, testing, product cost increases, and other costs unless otherwise required by law or agreed in writing by Concrete Shield.

Partial failure does not constitute failure of the entire floor or entire project. Concrete Shield determines the appropriate repair method, materials, preparation, and scope of repair.

22.Warranty Exclusions

Concrete Shield’s warranties do not cover damage, failure, defects, or appearance issues caused in whole or in part by:

  • Moisture vapor transmission, hydrostatic pressure, water intrusion, leaks, drainage problems, or condensation.
  • Efflorescence, high alkalinity, soluble salts, or freeze-thaw conditions.
  • Weak, deteriorated, dusty, hollow, or defective concrete; improper substrate construction, mix, or curing of the original slab.
  • Slab contamination — oil, silicone, chemical — or prior coatings, sealers, adhesives, or curing compounds.
  • Concrete cracking, crack movement, control-joint movement, expansion-joint movement, structural movement, settling, heaving, ground movement, earthquakes, acts of God, or substrate failure.
  • Spalling, pitting, dusting concrete, out-gassing, bubbles, pinholes, or craters.
  • Damage from vehicles, tools, equipment, furniture, jacks, jack stands, dragging, gouging, scraping, impact, sharp objects, metal wheels, snow blowers, snowplows, or heavy loads.
  • Damage from welding, hot materials, sparks, burns, or excessive heat.
  • Chemicals, solvents, acids, brake fluid, battery acid, deicers, fertilizers, cleaners, oils, gasoline, harsh detergents, or other contaminants.
  • Staining, discoloration, tire marks, tire plasticizer migration, hot tire marking, or rubber transfer.
  • Improper cleaning, improper maintenance, or failure to follow maintenance instructions.
  • Abuse, misuse, neglect, accidents, abnormal use, or customer-caused damage.
  • Repairs, alterations, recoats, or modifications by anyone other than Concrete Shield.
  • Customer’s refusal or failure to approve recommended preparation, repair, moisture testing, moisture mitigation, or substrate correction.
  • Exterior exposure, UV exposure (unless expressly covered in writing), weather exposure, garage aprons, driveways, or outdoor areas exposed to the elements.
  • Cosmetic variation in color, gloss, chip distribution, texture, or finish; color, texture, or gloss mismatch during repairs.
  • Normal wear and tear.

23.Warranty Claim Procedure

The customer must submit warranty claims in writing within 30 days after discovering the issue. A warranty claim should include:

  • Customer name.
  • Property address.
  • Installation date, if known.
  • Description of the issue.
  • Photographs of the affected area.
  • Proof of payment, if requested.
  • Any maintenance or cleaning information reasonably requested by Concrete Shield.

The customer must allow Concrete Shield a reasonable opportunity to inspect the floor before any repair, alteration, removal, or replacement is performed by others. If the customer repairs, recoats, removes, alters, or hires another contractor to work on the affected area before Concrete Shield has a reasonable opportunity to inspect, warranty coverage for that area may be denied.

Warranty coverage is conditioned on payment in full and compliance with maintenance instructions.

24.Warranty Remedy

If Concrete Shield determines that a claim is covered, Concrete Shield’s sole obligation is to repair, recoat, replace materials for, or otherwise correct the affected area, at Concrete Shield’s discretion.

Warranty repairs are limited to the affected area. Concrete Shield is not required to replace or recoat the entire floor or project because of a localized issue. Color, gloss, texture, chip distribution, and finish matching cannot be guaranteed.

The warranty does not provide refunds, project-wide replacement, consequential damages, loss-of-use damages, storage costs, vehicle rental costs, lodging costs, or compensation for inconvenience.

25.Maintenance

The customer is responsible for regular cleaning and maintenance of the coated surface.

The customer must follow Concrete Shield’s maintenance instructions and must avoid harsh chemicals, abrasive cleaning methods, standing water, unapproved cleaners, dragging heavy items, sharp objects, impact, and other conditions that may damage the coating. Failure to properly maintain the floor may void warranty coverage for the affected area.

26.Limitation of Liability

To the fullest extent permitted by law, Concrete Shield’s liability for covered warranty claims is limited to the warranty remedies stated in these Terms or the written warranty.

For non-warranty claims arising out of the quote, contract, services, installation, materials, or coated surface, Concrete Shield’s total liability shall not exceed the amount actually paid by the customer for the work giving rise to the claim.

Concrete Shield shall not be liable for incidental, consequential, special, indirect, exemplary, or punitive damages, including but not limited to loss of use, lost profits, business interruption, inconvenience, storage costs, lodging, vehicle rental, cleaning costs, replacement of personal property, or damage to items not removed from the work area.

Nothing in these Terms limits rights or remedies that cannot legally be limited.

27.Customer Property and Adjacent Areas

The customer is responsible for removing or protecting property in and near the work area. Concrete Shield is not responsible for dust, vibration, odor, minor overspray, incidental contact, or other ordinary effects of concrete preparation and coating work on items left in or near the work area, except to the extent caused by Concrete Shield’s gross negligence or willful misconduct.

The customer is responsible for protecting walls, trim, doors, appliances, cabinets, stored items, landscaping, vehicles, finished surfaces, and adjacent areas unless specific protection is included in the quote.

28.Photos and Project Records

Concrete Shield may take photographs or videos of the work area before, during, and after installation for documentation, warranty evaluation, training, quality control, marketing, or project records.

Concrete Shield will not intentionally publish the customer’s personal identifying information with project photos without permission. A customer may request in writing that project photos not be used for marketing.

29.No Other Warranties

To the fullest extent permitted by law, Concrete Shield disclaims all warranties not expressly stated in these Terms, the approved quote, or a separate written warranty.

Any implied warranties that cannot legally be disclaimed are limited to the shortest period permitted by law. This limitation does not reduce any rights that cannot legally be limited.

30.Disputes, Governing Law, and Venue

The parties will first attempt in good faith to resolve any dispute informally. Either party may request a site inspection, written explanation, photographs, or other reasonable information related to the dispute.

These Terms and the project shall be governed by the laws of the State of Illinois, without regard to conflict-of-law rules. Unless a valid and enforceable arbitration agreement has been separately accepted by the customer where required by law, any lawsuit shall be filed in a court of competent jurisdiction in Illinois.

If Concrete Shield uses a binding arbitration agreement, jury-trial waiver, or similar dispute-resolution provision, such provision applies only if presented and accepted in a legally enforceable manner. If required by law, the customer must be given the opportunity to accept or reject arbitration or jury-waiver provisions.

31.Entire Agreement

These Terms, the approved quote, any written warranty, any written maintenance instructions, and any written change orders form the entire agreement between the customer and Concrete Shield.

No verbal statement, prior negotiation, advertisement, website statement, photograph, sample, display, text message, or informal communication changes these Terms unless agreed to in writing by Concrete Shield.

32.Severability

If any part of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

33.No Waiver

Concrete Shield’s failure to enforce any provision of these Terms does not waive the right to enforce that provision later.

34.Assignment

The customer may not assign warranty rights, claims, or obligations without Concrete Shield’s written consent. Concrete Shield may assign payment rights, collection rights, or contract rights as permitted by law.

35.Acknowledgment

By approving a quote, accepting an estimate, scheduling work, paying a deposit, making payment, electronically approving a proposal, or allowing work to begin, the customer acknowledges that they have had an opportunity to review these Terms & Conditions, the project quote, warranty limitations, exclusions, payment terms, and maintenance responsibilities.
